Now is the time to announce this week’s Song Stealer of the Week. Well done, Dua Lipa! Oh wait, that’s the alleged thief of the song of the week. It’s really important. Alleged everyone, definitely alleged.
Because, yes, another somewhat dubious lawsuit for song theft has been filed in US courts. Florida-based band Artikal Sound System reckons Dua Lipa’s 2020 hit “Levitating” is a big old scam of their 2017 track “Live Your Life.”
Although, at least in their initial legal filing, they don’t provide the usual detailed musical analysis as to what notes and rhythms the two songs have in common. They also don’t quote one of those musicologists insisting that the two songs are so similar that it can’t be a coincidence. They also don’t provide an in-depth theory on how Dua Lipa may have heard their track before writing “Levitating.”
“Artikal Sound System has been performing and touring together since 2010 and their album on which the song ‘Live Your Life’ appeared on the Billboard charts at number two in the reggae section in 2017,” their lawsuits state. “‘Live Your Life’ was released on CD Baby in 2017 and has appeared on a variety of streaming services including Spotify, Pandora, Apple Music, Amazon and SoundCloud. The recording was and continues to be commercially available “.
“In 2020, on information and belief, the defendants listened to and copied ‘Live Your Life’ before and during the time they were writing ‘Levitating'”, he adds then. “’Levitating’ is substantially similar to ‘Live Your Life’. Given the degree of similarity, it is highly unlikely that ‘Levitating’ was created independently of ‘Live Your Life’”.
“Highly unlikely” you say? Well, what are you waiting for in the District Court for the Central District of the Western Division of California? Give these guys statutory damages. We now await Dua Lipa’s indignant and dismissive response.
